TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FEDERAL AND STATE LAW, IN NO EVENT SHALL GREEN LANTERN PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES.
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR PERSONAL INFORMATION STORED THEREIN.
• DAMAGES ARISING FROM YOUR INABILITY TO ACCESS OR USE THE SITE OR SERVICES.
• DAMAGES ARISING FROM ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE TRANSMITTED THROUGH THE SITE BY THIRD PARTIES.
• DAMAGES ARISING FROM ANY CONTENT OR CONDUCT OF ANY THIRD PARTY ON THE SITE.

IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF GREEN LANTERN PIZZA TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO GREEN LANTERN PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

THE FOREGOING LIMITATIONS APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF GREEN LANTERN PIZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

11. Indemnification

You agree to defend, indemnify, and hold harmless Green Lantern Pizza, its parent companies, subsidiaries, affiliates, and their respective officers, directors, employees, agents, licensors, suppliers, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

We cannot guarantee that any item is completely free from allergens due to the shared preparation environment. Green Lantern Pizza shall not be liable for any adverse reactions, health consequences, or damages resulting from undisclosed food allergies or sensitivities where reasonable allergen information has been made available.

13. Governing Law and Jurisdiction

These Terms of Service and any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or your relationship with Green Lantern Pizza shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Green Lantern Pizza is registered and operates, without regard to its conflict of law principles.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute, claim, or controversy informally by contacting Green Lantern Pizza at [email protected] with a written description of the dispute and your desired resolution. We will attempt to respond to and resolve your concern within thirty (30) days of receipt.

14.2 Binding Arbitration

If a dispute cannot be resolved informally within thirty (30) days, you and Green Lantern Pizza agree that any and all disputes, claims, or controversies arising out of or relating to these Terms, the Site, or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in the English language, and the arbitral award shall be final and binding on both parties.

The arbitrator shall have authority to award any remedy that would otherwise be available in a court of competent jurisdiction, except that the arbitrator shall not have authority to award punitive damages unless expressly permitted by statute. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

14.3 Class Action Waiver

YOU AND GREEN LANTERN PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND GREEN LANTERN PIZZA EACH WAIVE ANY RIGHT TO A JURY TRIAL.

14.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights, misappropriation of trade secrets, or other irreparable harm, without waiving the right to arbitration for other disputes.

15. Term and Termination

These Terms shall remain in full force and effect for as long as you use the Site or Services. We reserve the right, in our sole discretion, to:

• Terminate or suspend your access to the Site and Services at any time, with or without notice, for any reason, including violation of these Terms.
